Chile: the importance of trademark registration indication
The absence of the symbols ‘Marca Registrada’, ‘M.R.’ and ‘®’ may have significant practical consequences in the case of counterfeiting 10 September 2026
Obligation to indicate the registration of the trademark
We remind you that in Chile, if a registered trademark is used in trade, it should be visibly accompanied by one of the following indications:
- "Trademark"
- "M.R."
- "®"
These indications make it possible to make third parties aware that the sign enjoys protection as a registered trademark.
What are the consequences of not indicating?
Failure to affix the aforementioned information does not affect the validity or effectiveness of the registration of the mark.
However, their absence may have significant practical consequences in the event of infringement, as it could preclude the possibility of bringing criminal proceedings against the persons responsible for the infringement.
Recommendations for trade mark owners
It is recommended that companies using trademarks registered in Chile verify that the trademark is accompanied by one of the following indications:
Trademark | M.R. | ®
The adoption of this measure can help to strengthen the protection and enforcement tools available in the event of unauthorized use of the trademark.
